Thank you for visiting fandeytech.com (“Fandey Tech,” “we,” “us,” or “our”). Fandey Tech is a web development studio operated by FandeyTech Holdings, Inc..

This Privacy Policy (the “Policy”) describes how we collect, use, disclose, and safeguard information when you visit this website or contact us through it (collectively, the “Services”).

1. Scope and applicability

This Policy applies to everyone who accesses the Services, regardless of location. By using the Services you acknowledge that you have read and understood the practices described here. If you do not agree, please discontinue use of the Services.

This Policy does not apply to third-party websites linked from the Services, or to information you provide directly to a third party. Those interactions are governed by that party's own policies.

2. Information we collect

This is a marketing website. There are no user accounts, no uploads, and no payments taken here — so there are only two ways it collects anything.

2.1 Information you provide

When you submit the contact form, we collect the name, email address, website address and message you enter. There are no hidden fields. If you email us directly, we collect whatever that message contains.

2.2 Information collected automatically

Only if you accept the cookie notice. If you do, our analytics provider records technical and usage information — IP address (from which approximate city or region may be inferred), browser type and version, operating system, screen size, the pages you view, how you arrived, and how long you stay. We do not collect precise geolocation from your device.

If you decline, or simply ignore the notice, none of this is collected and no analytics cookie is set. Our web host also keeps standard server logs for security and reliability, as any website does.

2.3 Cookies and similar technologies

We use a single item of browser local storage to remember your cookie choice, so we don't ask again. That is strictly necessary and is set regardless of your choice.

Analytics cookies are set only after you accept. We do not use cookies for third-party targeted advertising. You can also control or block cookies through your browser settings.

3. How we use your information

  • To respond to you. Reply to enquiries, discuss potential work, and provide quotes.
  • To improve the Services. Understand which pages are read so we know what's worth writing more of.
  • Security and integrity. Detect and prevent spam, abuse, and malicious activity.
  • Legal compliance. Comply with applicable law and respond to lawful requests.

We process personal data only for purposes reasonably necessary and proportionate to the services we provide, and we do not process it for materially different purposes than those disclosed at collection without your consent.

4. Legal bases for processing

If you are in the European Economic Area, the United Kingdom, or another jurisdiction requiring a legal basis, we rely on:

  • Legitimate interests — to respond to enquiries, secure the Services, and defend our legal rights.
  • Consent — for analytics cookies. You may withdraw consent at any time.
  • Legal obligation — to comply with applicable law and lawful process.

5. Sharing and disclosure

We share personal data only with the following categories of recipients:

  • Service providers and processors. Contact form messages are delivered by Mailgun. Analytics, where accepted, are processed by PostHog. We also use a web host. These providers process personal data only on our instructions.
  • Legal and safety. Law enforcement, courts, or regulators where we believe disclosure is required by law or necessary to protect rights, property, or safety.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to protections consistent with this Policy.
  • Affiliates. Entities under common ownership with FandeyTech Holdings, Inc., for the purposes described here.
  • With your consent. Any other disclosure you agree to.

5.1 No sale of personal data

We do not sell personal data in exchange for monetary or other valuable consideration, and have not done so in the preceding twelve (12) months. We also do not “share” personal data for cross-context behavioral advertising as that term is defined under the California Consumer Privacy Act (“CCPA”).

5.2 No targeted advertising

We do not engage in targeted advertising and do not disclose personal data to third parties for that purpose as defined under applicable state privacy laws. We run no advertising networks, retargeting pixels, or social trackers.

6. Sensitive data

We do not seek to collect sensitive categories of personal data (such as racial or ethnic origin, religion, health information, sexual orientation, immigration status, biometric identifiers, precise geolocation, or data of known minors under 13). To the extent any is revealed to us, we limit processing to what is strictly necessary and will not sell it under any circumstances.

7. Data retention

We keep enquiries for as long as reasonably necessary to respond and to maintain a record of our dealings, and delete them once a conversation is clearly concluded and no legal or accounting obligation requires retention. Analytics data is retained according to our provider's standard retention period. Where deletion is not immediately feasible (for example, data preserved in backups), we isolate it from further processing until deletion is possible.

8. Data security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, alteration, disclosure, or destruction, including encryption in transit and restricted access controls. No method of transmission or storage is fully secure, and we cannot guarantee absolute security.

9. International transfers

Fandey Tech is operated from the United States. If you access the Services from elsewhere, your personal data may be transferred to, stored in, and processed in the United States or other jurisdictions where we or our service providers operate, whose data-protection laws may differ from those of your country. Where transfers occur from the European Economic Area or the United Kingdom, we rely on appropriate transfer mechanisms (such as the Standard Contractual Clauses) to the extent required by law.

10. Children's privacy

The Services are not directed to children under 13 and we do not knowingly collect personal information from them. If we learn we have, we will delete it promptly. We do not sell the personal data of anyone we know or should know is under 18, and do not process it for targeted advertising, regardless of consent, where required by applicable law (including Maryland's Online Data Privacy Act).

11. Your privacy rights

Subject to applicable law and certain exceptions, you may have the right to: know and access the personal data we hold about you; correct inaccurate data; delete data; receive a portable copy; opt out of sale, targeted advertising, and certain profiling (we do none of these, but you retain the right to ask); limit use of sensitive data; withdraw consent; and not be discriminated against for exercising any of these rights.

11.1 How to exercise your rights

Email bijan@fandeytech.com. We may need to verify your identity, or the authority of an agent acting for you, before responding. We will respond within the time required by applicable law.

11.2 Changing your cookie choice

You can change your mind at any time — withdrawing consent is as easy as giving it. Declining stops any further collection immediately.

11.3 Universal opt-out mechanisms

Where required, we honor recognized universal opt-out signals including Global Privacy Control (GPC), and our analytics respects browser-level Do Not Track. Because we neither sell personal data nor advertise, the practical effect is limited — we nonetheless treat such signals as a valid expression of your preferences.

11.4 Authorized agents and appeals

You may designate an authorized agent to submit requests on your behalf; we may require proof of authorization. If we decline to act on your request, you may appeal by contacting us and stating that you wish to appeal. If the appeal is denied, you may complain to your state attorney general or other regulator.

12. State-specific rights

Where this section conflicts with the rest of the Policy, the more protective provision applicable to you controls.

Maryland residents. The Maryland Online Data Privacy Act (“MODPA”) provides the rights described in Section 11. We limit collection to what is reasonably necessary and proportionate, do not sell sensitive data regardless of consent, and do not sell or target advertising to anyone under 18. Complaints may go to the Maryland Office of the Attorney General, Consumer Protection Division.

California residents. The CCPA provides the rights described in Section 11. The categories collected, purposes, sources, and recipients are described in Sections 2, 3, and 5. We have not sold or “shared” personal information in the preceding twelve months and do not knowingly do so for consumers under 16. Complaints may go to the California Privacy Protection Agency or the California Attorney General.

Other U.S. states. Residents of Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, Washington, and other states with comprehensive privacy laws have the rights described in Section 11, subject to their state's provisions and exceptions.

13. International users

If you are in the European Economic Area, the United Kingdom, or another jurisdiction whose data-protection law applies, you may have additional rights, including the right to lodge a complaint with your local supervisory authority.

14. Third-party links

The Services link to third-party websites we do not operate. This Policy does not apply to them; review their policies before providing personal data.

15. Changes to this Policy

We may update this Policy from time to time. The “Last revised” date above reflects when the most recent changes took effect. Material changes will be signposted before they take effect. Continued use after the effective date constitutes acceptance.
